Commencement of Filing Petitions and Grievances

05/29/20

What is new in the tax certiorari world: Courts have now permitted the filing of new matters. We will be filing petitions against villages and against Nassau County throughout the month of June. We will also be filing grievances against towns for Suffolk properties. Finally, we will be calendaring many matters with the court for the 2016/17 tax year. The Governor has given counties, towns and villages authority to extend the time for residents and business owners to pay their real estate taxes.   We must wait for each jurisdiction to approve additional extensions of the time to pay taxes without having to incur penalties and interest. Stay tuned. All ASIE filing for Nassau commercial properties must be completed by June 1, 2020. This filing must be completed online. You can learn more at the Nassau County Department of Assessment website.   All property owners should file for all available exemptions to secure reductions in taxes. This is an easy way to obtain immediate tax relief. This is available from the state and from local municipalities https://www.tax.ny.gov/pit/property/exemption/index.htm  https://www.nassaucountyny.gov/1502/Exemption-Brochures https://www.nassaucountyny.gov/3575/Exemption-Forms. Various Suffolk town websites have directions as to how to receive relief. See https://www.huntingtonny.gov/tax-exemptions https://www.townofbabylon.com/DocumentCenter/View/3945/Exemption-Booklet-2020-PDF We anticipate a huge spike in real estate taxes to first take effect in October 2020 for the first half of the 2020/21 school taxes and first half Suffolk taxes, payable December 1, 2020. Nassau and Suffolk Counties have each taken in at least 20% less sales tax, and will need additional funds to cover their costs due to the current crises. The tax rates will not be issued until October 2020, and banks are already collecting additional escrow payments in anticipation of this increase, even more of a reason why everyone should file for assessment relief annually.
